DACA UNDER THE TRUMP ADMINISTRATION

Disclaimer: This advisory has been created by The Legal Aid Society, Immigration Law Unit.
This advisory is not intended as legal advice and is not a substitute for the advice of an immigration expert.

If I have DACA now, what happens to my status and work permit?
 If you have DACA now, your status and work permit will remain in effect until the expiration of your current two-year DACA period, unless your status is terminated or revoked.

If I have DACA now, can I renew it?
 If you filed a DACA renewal application and it was pending on September 5, 2017, it will be decided under the regular eligibility criteria for DACA.
 If you have DACA and your status is expiring between September 5, 2017 and March 5, 2018, you must file a renewal application on or before October 5, 2017.

Can I apply for DACA now, for the first time?
 If you do not already have DACA now, you cannot file an initial application anymore.
 If you filed an initial DACA application and it was pending on September 5, 2017, it will be decided under the regular eligibility criteria for DACA.

I was approved for Advance Parole – can I still travel abroad?
 If you were granted Advance Parole based on DACA, you can use it now to travel abroad, while you remain in valid DACA status and while the grant of Advance Parole remains valid. If you have ever been arrested, however, you should review your criminal history with a qualified immigration practitioner before traveling abroad.

Can I apply now for Advance Parole?
 It is no longer possible to file a new application for DACA-based Advance Parole now.
 If you filed an application for DACA-based Advanced Parole and it was pending on September 5, 2017, USCIS will not decide your application. Instead, the agency will refund the filing fee to you, and will “administratively close” your case, meaning it will no longer be pending.
